Work Injury Overview

Allow us to begin with some general information regarding workers compensation.  Workers compensation is designed to provide benefits to employees who have been injured at work through a no fault system.  This basically means that to establish liability, the employer and the employee do not need to prove negligence on either side as a defense to a claim.

Work related injuries include conditions caused, aggravated, or accelerated by the activities performed on the job. These injuries include traumatic, gradual, or even occupational disease.  For example, traumatic injuries may include an auto accident while driving between work sites.  Gradual injuries may include occupational exposure at the workplace from toxins like gases, fluids, chemicals, and molds.  Occupational diseases would include, but is not limited to TB or valley fever.

The only thing the employee must prove is that the injury was caused due to job activities and were a “substantial contributing factor” in the need to seek medical attention.

Workers compensation provide four very basic types of benefits.  These benefits include wage loss, compensation for the loss of use of part of the body, medical benefits, and vocational rehabilitation services.

In Minnesota, the worker’s compensation statue entitles injured employees to reasonable and necessary medical treatment.  For your reference, this is Minnesota Statutes 176.135 Subd. 1.  This basically means that your employer is required to provide for any medical, psychological, chiropractic, podiatric, surgical and hospital treatment if you are injured on the job.
